1. General
Please read these terms of use carefully. By registering for the ProClinic service or by using the service, you accept these terms of use (hereinafter "terms").

The ProClinic booking system (hereinafter "the ProClinic service") is a web-based booking service provided by ProClinic AS (hereinafter "ProClinic"), which customers (hereinafter "you") can use to book services offered by third parties (hereinafter "clinics" or "service providers"). If you are under 18 years of age, you must obtain consent from your guardians before accepting these terms. If you do not accept these terms, or if you do not have the authority to act as a contracting party, either on your own behalf or as a representative of your group, you do not have the right to use the ProClinic service.
2. How the Service Works
The purpose of the ProClinic service is to facilitate online appointment bookings for both customers and service providers. Use of the ProClinic service requires registration. It is not ProClinic that sells or markets the services that can be booked via the ProClinic service. The service providers sell and market their own services using the ProClinic service. ProClinic only functions as a booking service for the service provider's services. If the service in question is paid for through the ProClinic service, ProClinic also functions as a payment intermediary.
These terms only apply to the connection between you and ProClinic. ProClinic does not commit to the service providers' terms of use or other terms. When you book services via the ProClinic service, you commit to managing the booked service yourself. In addition, you are obliged to follow these terms as well as the service provider's booking conditions. After completing the booking, the service provider may send you a confirmation of the booking, where the service provider has the right to set more detailed reservation or booking conditions. Reservations that are not prepaid can be cancelled in the ProClinic service. This happens within the framework specified by the service provider in their own cancellation terms, as well as through the ProClinic service's cancellation practice.
In some situations, you can prepay for the service to the service provider via ProClinic. Payments are mediated through the payment service provider. The payment service provider then transfers the received payment to the service provider offering the service.
ProClinic is not responsible for the services that the service providers deliver or for the service's content, quality, warranty or other conditions. Complaints and inquiries regarding the service you have booked via the ProClinic service (for example, cancellation or change of appointment) must be sent directly to the service provider. The ProClinic service's areas of responsibility are described in more detail below.
If you have given your consent, both the service provider and ProClinic can send you marketing messages related to their services or similar services. Regarding the service provider's business, it is the service provider who acts as the controller of personal data and ensures that privacy law is complied with. The privacy practice is described in more detail below.
ProClinic has the right to change the ProClinic service at any time.
3. Right to Use the Service and Purpose of the Service
You give your consent to use the ProClinic service only for the purpose for which the ProClinic service is intended. Use of the ProClinic service for illegal, inappropriate or competitive purposes is strictly prohibited, which is why ProClinic reserves the right to intervene in violations.
You consent to use the ProClinic service by only providing correct and specific information, and that you do not communicate illegal or inappropriate information via the ProClinic service.
ProClinic has the right to delete your information or block your access to the ProClinic service if ProClinic suspects a breach of the terms or illegal or inappropriate activity, or if ProClinic must fulfill its legal obligations or acts at the request of a public authority.
The ProClinic service's property rights and all intellectual property rights belong to ProClinic or its contracting parties.
4. Terms of Use for Referral Codes and Campaign Codes
Referral and campaign codes are limited to one code per person. It is strictly forbidden to create multiple accounts for one person with the purpose of abusing referral and campaign codes.
5. Privacy

By using the ProClinic service, you also accept ProClinic's privacy practices. For a more detailed description of ProClinic's privacy practices, you can see ProClinic's privacy description.
You commit to following the guidelines described in ProClinic's privacy description as well as the following practices:
- When you use or register with the ProClinic service, you accept that your personal data will be transferred to ProClinic.
- The personal data you provide in the ProClinic service in connection with your booking will also be transferred to the service provider. The service provider is responsible for how the personal data is used and acts as the data controller.
- ProClinic has the right to use all information created in connection with the use of the ProClinic service for the following purposes: Maintaining the functionality of the ProClinic service, correcting any error situations, developing and changing the ProClinic service, and fulfilling its obligations and exercising its rights in accordance with the terms (for example, to contact you if an error situation occurs). If you have given your consent to this, ProClinic also has the right to use your information for marketing purposes.
- In addition, ProClinic has the right to use the anonymous information created by using the ProClinic service for marketing and to develop ProClinic's business operations. ProClinic can use the information in the ProClinic service, among other things, to create statistics about the bookings made via the ProClinic service, as well as about customers and other information that does not reveal your identity.
The rights and obligations that regulate the use of personal data will apply in accordance with the law, even after the use of the ProClinic service or the delivery of the service provider's service has ended.
6. ProClinic's and Your Responsibility
ProClinic is not responsible for the products or services that you book via the ProClinic service. It is the service provider who offers the products and services to you in their own name and at their own expense.
ProClinic has no liability for direct or indirect damages and inconveniences caused by the use of the ProClinic service or the service providers' services.
You are personally responsible for any damages and inconveniences that the use of the ProClinic service has caused you.
You bear full responsibility for any damages and inconveniences that you cause to ProClinic, the service provider and other relevant third parties.
The ProClinic service is actively being developed and ProClinic tries to build the service in a way that ensures good information security. Since this is an online service, we point out that ProClinic offers the ProClinic service as is. ProClinic cannot guarantee that the ProClinic service is available without interruption or that it is error-free, nor that all information and all material found in the ProClinic service is without harmful programs and other inconveniences. If you discover or suspect something harmful in the ProClinic service, we ask you to contact ProClinic immediately.
It is possible to register for the ProClinic service via a service or interface provided by a third party (e.g. Facebook or Google). The ProClinic service's websites may contain hyperlinks to websites that are not maintained by ProClinic. ProClinic does not monitor third-party websites and is not responsible for the content, use or terms of use that apply to these websites. The fact that the ProClinic service offers links to these websites does not mean that ProClinic approves the content on these websites, or that ProClinic monitors the content.
In addition to what is mentioned above, so-called force majeure situations can also make it difficult or prevent ProClinic from reacting and intervening in disturbances, illegalities and damages.
7. Validity and Changes to Terms
You can stop using the ProClinic service at any time by ending your subscription to the ProClinic service using the "Delete me" function or other similar action that deletes user data. You can find the "Delete me" functionality in the "Privacy" section of the "My Account" page. Please note that even if you delete your user information in the ProClinic service, your information will not be deleted in databases belonging to service providers you have booked an appointment with via the ProClinic service. We ask you to contact the service providers directly to delete your information.
ProClinic can terminate or block your access to the ProClinic service at any time, if ProClinic believes there is a well-founded reason for this.
ProClinic can change these terms at any time. You accept the new terms by continuing to use the ProClinic service after the terms have been changed. If you do not accept the changes, you must stop using the ProClinic service and delete your user information, according to the instructions above.
After the use of or access to the ProClinic service has ended, the terms of use that are of such a nature that they are required to remain maintained (especially those regarding liability and dispute resolution) will continue to apply.
8. Transfer of Rights
ProClinic has the right to transfer the ProClinic service, its production and associated rights and obligations to a third party without your consent. This right includes the right to transfer personal data related to you to a third party, if the ProClinic service or parts of it are transferred to a third party.
9. Cancellation and Fee for No-Show
Bookings can be cancelled free of charge until the cancellation deadline stated at booking. The cancellation deadline varies depending on which service you book and will be clearly communicated to you during the booking process.
If you cancel after the cancellation deadline has expired, or if you do not show up for your scheduled appointment without cancelling, you will be charged a fee. The size of the fee is stated at booking and varies depending on the service.
In case of no-show, you will receive an SMS with a payment link for the fee. You have three (3) business days to pay the fee from when you receive the payment link. If the fee is not paid within the deadline, the case will be forwarded to a collection agency for further handling.
Upon forwarding to collection, you will in addition to the original fee be responsible for collection fees and any interest in accordance with applicable legislation (the Collection Act and the Late Payment Interest Act). The service provider and ProClinic reserve the right to refuse future bookings if fees are not paid.
10. Dispute Resolution and Applicable Law
Norwegian law applies to disputes and disagreements about the use of the ProClinic service and these terms. In disputes, it is also possible to use legislation and practices that apply to the service provider's place of business.
We try to resolve all disputes through mediation. If agreement is not reached despite mediation, the dispute can be handled by Oslo District Court as first instance. If the consumer brings a claim against ProClinic based on mandatory consumer protection law, the claim can also be handled by a lower court from the jurisdiction the consumer has the right to try the dispute, in accordance with local law.
